Climate litigation is the act of fighting for climate justice in a legal environment. Climate litigation is increasingly gaining ground and becoming a legitimate way to hold the largest polluters accountable for climate change-related damages. According to the United Nations Environment Programme (UNEP), climate litigation represents a frontier solution to change the dynamics of the fight against climate change.
KELA membership is dominantly lawyers and therefore our strength lies with not only liaising with the government in drafting, reviewing and amendment the relevant legislation on the environment but also champion the enforcement and seek injunctions from the courts to prohibit the violation of the right to clean and healthy environment.
The Kenyan judiciary has set up specialized courts that deal with environment planning. This
gives litigants an opportunity to seek court redress in the event of such.
